Mumias Verfahren: neuer Hinweis auf Interessenskonflikt

In einer kurzen Anhörung am Donnerstag, dem 30. August vor Richter Tucker am Stadtgericht in Philadelphia (USA) tauchten neue Hinweise auf einen Interessenskonflikt von Ex-Richter Castille auf, der in Mumias Verfahren nicht nur als Berufungsrichter, sondern zuvor auch als Staatsanwalt tätig war. Zur genaueren Untersuchung wurde die Sitzung aufgehoben und eine weitere für den 29. Oktober 2018 angesetzt.

 

Nachdem die Staatsanwaltschaft von Philadelphia nach knapp zwei Jahren noch immer nicht alle Akten über Mumia Abu-Jamal an den Kontrollrichter ausgehändigt hat, kam es heute im Gerichtssaal zu einer weiteren Enthüllung. Kern der juristischen Untersuchung ist die Frage, inwieweit Ex-Richter Ron Castille 1998 in einem Interessenskonflikt stand, als er Mumias Revisionsverfahren einstellte. Ron Castille war damals nicht nur politischer Kandidat der Fraternal Order of Police (FOP), die die stärkste Lobbygruppe für die Hinrichtung des afroamerikansichen Journalisten war (und bis heute ist). Ab 1986 leitete Castille die Bezirksstaatsanwalt von Philadelphia. Er war also dafür zuständig, dass 1982 gegen Mumia in einem manipulierten Verfahren erlassene Todesurteil auch zu vollstrecken. Castille hat in den vergangenen zwei Jahren reichlich unglaubwürdig behauptet, als Staatsanwalt überhaupt nicht mit dem Fall befasst gewesen zu sein.

 

 

 

In den bisher an Richter Tucker überreichten Akten fehlen zwar zahlreiche Unterlagen, aber mehrfach tauchen Hinweise in den Inhaltsverzeichnissen der Akten auf, die darauf hindeuten, dass die Behauptung von Castille nicht stimmt. Heute im Gericht ging es z.B. um einen fehlenden Brief, den der damalige Bezirksstaatsanwalt Castille an einen Regierungsbeamten namens Fischer schrieb. Ob es dabei um die Hinrichtung von Mumia Abu-Jamal ging, kann derzeit noch nicht geklärt werden, da der Brief aus den Akten verschwunden ist. Aber es zeigt deutlich, dass Staatsanwalt Castille sehr wohl mit dem Fall befasst war. Er hätte in den 1990er und 2000er Jahren nicht als Berufungsrichter über den Fall entscheiden dürfen.

 

 

 

Der US Supreme Court hatte Ron Castille zuletzt 2016 im Fall von Terrance Williams wg. einem praktizierten Interessenskonflikt gerügt und sein Urteil aufgehoben. Auch dort war Castille als Ankläger und später als Berufungsrichter tätig.

 

 

 

Sollte das jetzige Kontrollverfahren ebenfalls zu diesem Ergebnis kommen, müsste ein Großteil der Berufungsphase von Mumia Abu-Jamal (von 1990 – 2008) neu aufgerollt werden. Es würde dann ein neues PCRA (Post-Conviction Relief Act) genanntes Berufungsverfahren geben, in welchem auch die zahlreichen unterdrückten und z.T. neuen Beweise vor einer Jury verhandelt würden. Mumias Freiheit wäre damit wohl „nur“ noch eine Frage der Dauer der juristischen Abläufe.

 

 

 

Nachdem die FOP im vergangenen April den Gerichtssaal bewaffnet besetzte und den Richter bedrohte, beschränkte sie sich diesmal auf eine eigene Kundgebung in der Nähe des Gerichtsgebäudes, an der auch auch der hochbetagte Ex-Staatsanwalt Joseph McGill teilnahm, der mit gefälschten Beweisen 1982 die Jury in ein Todesurteil gegen Mumia manipuliert hatte. Er ist gegen eine neues Berufungsverfahren. Klar, er bekäme dann vermutlich eine Menge Ärger.

 

 

 

Direkt vor dem Gericht hatten Unterstützer*innen von Mumia in den frühen Morgenstunden bereits eine Solidaritätskundgebung mit dem politischen Gefangenen begonnen. Ähnlich wie im April 2018 verweigerten die Gerichtswachen zahlreichen Unterstützer*innen wieder den Zutritt zum Gerichtssaal.

In a brief hearing on August 30 before Judge Tucker in Philadelphia, a new hint at a conflict of interests on the part of ex-judge Castille emerged, who had been active both as DA and a appeals judge in Mumia's case. Judge Tucker postponed the session to October 29, 2018 to give the defense time to investigate.

 

 

 

Mumia Abu-Jamal's appeal request continued

Arguments in a request by former death row inmate Mumia Abu-Jamal (moo-MEE'-ah AH'-boo jah-MAHL') to have his previous appeals vacated have been postponed.

 

The district attorney's office turned over a document Monday that the defense says could show State Supreme Court Justice Ronald Castille was personally involved in the case. The judge Thursday ordered the parties to continue searching for additional documents before he hears arguments in October.

 

Lawyers for the former Black Panther, who spent 29 years on death row following his conviction in the 1981 murder of Philadelphia police Officer Daniel Faulkner, are petitioning to throw out the previous appeals to file a new appeal.

 

The defense has said Castille should have recused himself. When Castille was Philadelphia district attorney, his office succeeded in getting the state Supreme Court to uphold Abu-Jamal's conviction.

On Monday, lawyers said new evidence was found and turned over to indicate that former Pennsylvania Supreme Court Justice Ronald Castille was biased in upholding the murder conviction of a policeman against Abu-Jamal, who is serving a life sentence. A judge pressed parties Thursday to continue searching for more documents before presenting arguments in October, NBC-owned WCAU https://www.nbcphiladelphia.com/news/local/Convicted-Police-Officer-Kill... reported.

Abu-Jamal, like other convicted Black men, has had many failed appeals in fighting for freedom. The former member of the Black Panthers party, journalist and author spent 29 years on death row following his conviction in the 1981 murder of Philadelphia police officer Daniel Faulkner. The 64-year-old has maintained his innocence and become a symbol for criminal justice reform. His story has inspired activists to stage protests for securing his release after what they have said was a wrongful conviction. Questions about whether there was sufficient evidence in the case, substantial witness testimony and a fair jury have arisen over the years.

The defense team had to previously reset when a hearing was postponed in April. They were petitioning under the Post-Conviction Relief Act to have Abu-Jamal’s previous appeals thrown out to make way for the new appeal.

Abu-Jamal recently offered his thoughts about his conviction and previously being ordered to face the death penalty.
