Stellungnahme zur Razzia am 24. März in Berlin

Wir sind ein antifaschistisches Späti-Kollektiv in Berlin-Neukölln, entstanden aus dem Wunsch heraus, antifaschistische Themen, Selbstorganisation und revolutionäre Solidarität zu verbreiten. Als Späti möchten wir auf unkonventionelle Weise auf diese Themen aufmerksam machen. Über die drei Jahre unseres Bestehens haben wir ein gutes Verhältnis zur Nachbarschaft aufgebaut – zu Jung und Alt, Deutschen, Migrant*innen, Studierenden, Erwerbslosen und der Arbeiter*innenklasse Neuköllns. Ein Späti, wo man abends nicht nur ein Bier trinken, sondern sich auch über politische Themen informieren und selbstbedruckte T-Shirts kaufen kann, um Solidaritätsgelder zu sammeln oder Graffiti-Dosen besorgen, Treffen abhalten und sich mit anderen Genoss*innen vernetzen kann. Ziel der Razzia am vergangenen Dienstag war unter anderem, diesen Prozess zu sabotieren.  

Unter Führung des LKA 52 (KHK Salzmang) drang vermummte Polizei der 22. Einsatzhundertschaft morgens um 6 Uhr ein, indem sie Rollladen und Ladentür einschlugen. Unter Zuhilfenahme zweier Datenspürhunde beschlagnahmten sie Computer, Telefone (darunter Spenden für Geflüchtete), Speicherkarten, die Internet-Router für das freie W-Lan in der Nachbarschaft, Werkzeuge, Späti-Ware im Wert von hunderten von Euro und sogar das elektronische Zahlungsgerät. Erst gegen 13:30 Uhr zogen sie wieder ab und hinterließen ein Chaos, das nervige Aufräum- und Reparaturarbeiten verursachte.  

Unter dem Vorwand, Informationen über einige Genoss*innen zu sammeln, versuchten sie uns einzuschüchtern und zu spalten. Stattdessen erfuhren wir sofort eine große Welle an Solidarität, nicht nur von Genoss*innen, sondern auch aus der Nachbarschaft und von Menschen, von denen wir zuvor nicht erwartet hätten, dass sie sich auf unsere Seite stellen. Schließlich ist die Absurdität der Durchsuchung eines Späti, einer Bibliothek und eines Infoladens offensichtlich.  

Zu erwähnen ist auch die völlig unverhältnismäßige und illegale Durchsuchung der Wohnungen und Arbeitsplätze der Beschuldigten (und z.t. sogar die der Eltern). Auch die Durchsuchungsbeschlüsse waren lächerlich, da sie jegliche Hinweise vermissen ließen, die diese Razzien gerechtfertigt hätten. Sie raubten den Beschuldigten und den in den jeweiligen Wohnungen Anwesenden und anderweitig Mitbetroffenen all ihre elektronischen Geräte, nahmen sogar Tagebücher mit. Sie drangen mit vorgehaltener Waffe in die Zimmer einiger Leute ein und legten ihnen direkt Handschellen an. Die Zimmer wurden dann von der Polizei durchsucht und die Beschuldigten wurden festgenommen und zur Gefangenensammelstelle gebracht, wo ihnen nebst anderen Dreistigkeiten und Einschüchterungsversuchen ohne Einwilligung DNA-Proben entnommen wurden.
Beauftragt wurde die Razzia durch die Generalstaatsanwaltschaft Berlin und ein Richter Bäuml am Amtsgericht Berlin fertigte am 6. März den dazugehörigen Durchsuchungsbeschluss an. Der klang-, aber wenig gehaltvolle Vorwurf: "verfassungsfeindliche Sabotage". 

Die gesamte Aktion war ein willkürlicher Versuch, linke Strukturen einzuschüchtern, anzugreifen und zu schädigen. Sie wollten uns und der gesamten antifaschistischen Bewegung schaden. Jetzt sind wir zurück und stärker als je zuvor!
Solidarität mit Scherer8, Kalabal!k, Basta! und all jenen, die um 6 Uhr morgens von der Polizei mit Sturmhauben aus dem Bett gezerrt wurden!

A brief statement on the raids of March 24 

We are an anti-fascist Späti collective in Berlin-Neukölln, founded out of a desire to promote anti-fascist issues, self-organization, and revolutionary solidarity. As a Späti, we aim to draw attention to these issues in unconventional ways. Over the three years of our existence, we have built a good relationship with the neighborhood—with young and old, Germans, migrants, students, the unemployed, and the working class of Neukölln. A Späti where, in the evenings, you can not only have a beer but also learn about political issues, buy self-printed T-shirts to raise solidarity funds, get graffiti spray cans, hold meetings, and network with other comrades. One of the goals of last Tuesday’s raid was to sabotage this process.  

Led by LKA 52 (KHK Salzmang), masked police from the 22nd riot squad stormed the premises at 6 a.m., smashing the shutters and storefront door. With the help of two data-sniffing dogs, they seized computers, phones (including donations for refugees), memory cards, the internet routers for the free Wi-Fi in the neighborhood, tools, convenience store merchandise worth hundreds of euros, and even the electronic payment terminal. They didn’t leave until around 1:30 p.m., leaving behind a mess that required tedious cleanup and repair work.

Under the pretext of gathering information about some of our comrades, they are trying to intimidate and divide us. Instead, we immediately experienced a huge wave of solidarity, not only from comrades, but also from the neighborhood and from people we hadn’t expected to stand by our side. After all, the absurdity of raiding a corner store, a library, and an information center is obvious.  

It is also worth mentioning the completely disproportionate and illegal searches of the accused’s homes and workplaces (and in some cases even those of their parents). The search warrants were also ridiculous, as they lacked any evidence that would have justified these raids. They confiscated all electronic devices from the accused, those present in the respective apartments, and others affected, even taking diaries. They entered some people’s rooms at gunpoint and immediately handcuffed them. The rooms were then searched by the police, and the accused were arrested and taken to a detention center, where, in addition to other acts of audacity and intimidation, DNA samples were taken from them without their consent.
The raid was ordered by the Berlin Public Prosecutor’s Office, and on March 6, Judge Bäuml of the Berlin District Court issued the corresponding search warrant. The charge, which sounded impressive but lacked substance, was “anti-constitutional sabotage.” 

The entire operation was an arbitrary attempt to intimidate, attack, and undermine left-wing organizations. They wanted to harm us and the entire anti-fascist movement. Now we’re back and stronger than ever!

24 Mart'taki baskınlara ilişkin kısa bir açıklama 

Biz, Berlin-Neukölln'de faaliyet gösteren, antifaşist konuları, öz-örgütlenmeyi ve devrimci dayanışmayı yaygınlaştırma arzusuyla kurulmuş antifaşist,  kollektif bir Spätiyiz.Bir Späti olarak, bu konulara alışılmışın dışında bir şekilde dikkat çekmek istiyoruz. Üç yıllık varlığımız boyunca, genç ve yaşlı, Almanlar, göçmenler, öğrenciler, işsizler ve Neukölln işçi sınıfı dahil olmak üzere mahalle sakinleriyle iyi ilişkiler kurduk. Akşamları sadece bira içmekle kalmayıp, siyasi konular hakkında bilgi edinebileceğiniz, dayanışma fonu toplamak için elyapımı  tişörtler satın alabileceğiniz, sprey boya alabileceğiniz, toplantılar düzenleyebileceğiniz ve diğer yoldaşlarla ağ kurabileceğiniz bir Späti. Geçen Salı günü yapılan baskının amaçlarından biri de bu süreci sabote etmekti.  

LKA 52 (KHK Salzmang) liderliğinde, 22. Görev Timi'ne bağlı maskeli polisler sabah saat 6'da panjurları ve dükkan kapısını kırarak içeri girdi. İki veri arama köpeğinin yardımıyla bilgisayarları, telefonları (bunların arasında mülteciler için toplanan bağışlar da vardı), hafıza kartlarını, mahalledeki ücretsiz Wi-Fi için kullanılan internet yönlendiricilerini, aletleri, yüzlerce euro değerinde market ürünlerini ve hatta elektronik ödeme cihazına  elkoydular. Saat 13:30'a doğru ayrıldılar ve arkalarında sinir bozucu temizlik ve onarım işlerine neden olan bir kaos bıraktılar.   

Bazı yoldaşlarımız hakkında bilgi toplamak bahanesiyle, bizi sindirmeye ve bölmeye çalışıyorlar. Bunun yerine, sadece yoldaşlarımızdan değil, mahalleden ve daha önce bizim tarafımızda yer alacağını hiç beklemediğimiz insanlardan da büyük bir dayanışma dalgası ile karşılaştık. Sonuçta, bir spätinin, kütüphanenin ve bir bilgi merkezinin aranmasının saçmalığı ortada.  Sanıkların (ve hatta kısmen ebeveynlerinin) ev ve iş yerlerinin tamamen orantısız ve yasadışı bir şekilde aranmasından da bahsetmek gerekir. Arama kararları da gülünçtü, çünkü bu baskınları haklı gösterecek herhangi bir kanıt içermiyorlardı.

Sanıkların, ilgili evlerde bulunanların ve başka şekillerde etkilenenlerin tüm elektronik cihazlarına elkoydular, hatta günlükleri bile aldılar. Silah zoruyla bazı kişilerin odalarına girdiler ve onlara doğrudan kelepçe taktılar. Odalar daha sonra polis tarafından arandı ve sanıklar gözaltına alınarak tutuklu toplama merkezine götürüldü; burada diğer baski ve sindirme girişimlerinin yanı sıra, rızaları alınmadan DNA örnekleri alındı.Baskın, Berlin Başsavcılığı tarafından emredildi ve Berlin Asliye Mahkemesi’nden Yargıç Bäuml, 6 Mart’ta ilgili arama emrini düzenledi. Kulağa hoş gelen, ancak içeriği zayıf olan suçlama: “anayasaya aykırı sabotaj”. 

Tüm bu operasyon, sol yapıları sindirmek, sol yapılara saldırmak ve zarar vermek için keyfi bir girişimdir. Bize ve tüm antifaşist harekete zarar vermek asıl amaçlarıdır.Şimdi geri döndük ve her zamankinden daha güçlüyüz!
